These Terms of Service govern Your access to and use of Sprite Fusion, including the Website, the Tilemap Editor, Pixel Snapper, the Pixel Art Generator, desktop apps, downloads, subscriptions, credits, and related services. By using the Service, You agree to these Terms.
If You do not agree to these Terms, You must not use the Service. If You use the Service on behalf of a company or other organization, You represent that You have authority to bind that organization to these Terms.
Definitions
- Company, We, Us, or Our refers to Sprite Fusion.
- Service refers to Sprite Fusion and all related products, tools, websites, and services.
- You refers to the person or entity accessing or using the Service.
- User Content refers to prompts, uploaded images, tilesets, sprites, generated images, generated animations, maps, settings, files, feedback, and any other content You submit, create, import, or export through the Service.
- Output refers to images, animations, sprites, maps, files, or other materials generated, edited, exported, or downloaded through the Service.
Eligibility
You must be at least 13 years old to use the Service. If You are under the age of majority in Your jurisdiction, You may use the Service only with permission and supervision from a parent or legal guardian.
Accounts
Some parts of the Service may require an Account. You agree to provide accurate information, keep Your login credentials secure, and remain responsible for all activity under Your Account.
We may suspend, restrict, or terminate Accounts that violate these Terms, create legal risk, harm the Service, or appear fraudulent, abusive, or insecure.
User Content and License to Operate the Service
You retain the rights You have in Your User Content. You grant Us a limited, worldwide, non-exclusive license to host, process, transmit, reproduce, display, modify, and use Your User Content only as needed to provide, secure, moderate, troubleshoot, support, and improve the Service.
Some features rely on third-party service providers and AI infrastructure providers. You authorize Us to send User Content, generation settings, and job metadata to those providers as needed to provide the requested feature, prevent abuse, troubleshoot errors, and comply with legal obligations.
You represent that You have all rights, permissions, and legal authority needed to submit, upload, generate, edit, and use Your User Content and Outputs.
Outputs and Commercial Use
Subject to Your compliance with these Terms, We do not claim ownership over Outputs You create through the Service. You may use Outputs for personal or commercial projects.
You are solely responsible for reviewing Outputs before use. We do not guarantee that any Output is unique, copyrightable, trademark-safe, free from third-party rights, suitable for a specific project, or lawful in every jurisdiction or context.
AI-powered tools may produce unexpected, inaccurate, similar, or unusable results. You must not rely on the Service as a substitute for legal, copyright, trademark, or licensing review.
Restrictions
You agree not to use the Service to:
- Violate any law, regulation, contract, intellectual property right, privacy right, or other third-party right.
- Create, upload, request, or distribute illegal, abusive, hateful, harassing, deceptive, exploitative, or harmful content.
- Impersonate another person or misrepresent the origin, ownership, or endorsement of User Content or Outputs.
- Upload malware, attempt unauthorized access, overload infrastructure, or interfere with the Service.
- Scrape, crawl, extract, reverse engineer, bypass limits, or automate access except where We explicitly allow it.
- Resell, sublicense, proxy, or provide the Service to third parties as a competing or substantially similar service.
- Use Outputs, Service data, or Service access to train, fine-tune, benchmark, or improve machine-learning models without Our prior written permission.
- Remove notices, bypass payment or credit systems, abuse free tiers, or exploit bugs, promotions, refunds, or subscriptions.
Payments, Subscriptions, and Credits
Paid features may be sold as subscriptions, one-time purchases, desktop apps, usage credits, or other paid plans. Prices, included usage, feature availability, and limits may change over time.
Subscriptions renew automatically unless canceled before the renewal date. Cancellation stops future renewals but does not automatically refund prior charges or partially used billing periods unless required by law or stated in a specific offer.
Credits, usage allowances, and generation limits may expire, reset, be consumed by successful generations, or be held while a generation is pending. We may restore credits for failed generations at Our discretion or where the Service explicitly provides it.
We may correct pricing errors, refuse purchases, cancel abusive transactions, and suspend paid access where a payment fails, is reversed, is fraudulent, or violates these Terms.
Refunds
Except where required by law or stated in a specific offer, payments are non-refundable. Because AI-generated creative results can vary, dissatisfaction with a particular Output does not automatically create a refund right.
Service Availability and Changes
We may modify, pause, discontinue, limit, or remove any part of the Service at any time. The Service may be unavailable, slow, rate-limited, or fail because of maintenance, errors, third-party providers, infrastructure issues, abuse prevention, or circumstances outside Our control.
You are responsible for exporting and backing up any User Content or Outputs You need. We are not responsible for lost, corrupted, unavailable, or deleted User Content or Outputs except where applicable law says otherwise.
Our Intellectual Property
The Service, including software, design, source code, interfaces, branding, documentation, logos, and other materials We provide, is owned by Us or Our licensors. These Terms do not transfer any rights in the Service to You except the limited right to use it according to these Terms.
Third-Party Services
The Service may integrate with or depend on third-party services, infrastructure, payment processors, hosting providers, analytics tools, AI infrastructure, stores, links, or downloads. We are not responsible for third-party services, their availability, their content, or their legal terms.
Privacy
Our Privacy Policy explains how We collect, use, share, and retain information. By using the Service, You also agree to the processing described in the Privacy Policy.
Termination
You may stop using the Service at any time. We may suspend or terminate Your access to the Service if We believe You violated these Terms, created legal risk, abused the Service, failed to pay, or caused harm to Us, other users, third-party providers, or the Service.
Disclaimer
The Service is provided "as is" and "as available." To the maximum extent permitted by law, We disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.
Limitation of Liability
To the maximum extent permitted by law, We will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, lost goodwill, business interruption, or the cost of substitute services.
To the maximum extent permitted by law, Our total liability for any claim related to the Service will not exceed the greater of 100 USD or the amount You paid to Us for the Service during the one month before the event giving rise to the claim.
Indemnification
You agree to defend, indemnify, and hold Us harmless from claims, damages, liabilities, losses, and expenses arising from Your use of the Service, Your User Content, Your Outputs, Your violation of these Terms, or Your violation of law or third-party rights.
Changes to These Terms
We may update these Terms from time to time. Changes are effective when posted unless a later date is stated. If You continue using the Service after changes take effect, You accept the updated Terms.
Governing Law
These Terms are governed by the laws of France, except where applicable consumer protection laws require otherwise.
